Highways Transport Terms And Conditions Of Business

 

By booking transportation, you will have been deemed to have accepted our terms and conditions.

Definitions:

Consignor: A person or a company that is selling an item (Seller)

Consignee: A person or a company that is financially responsible (Buyer)

 

The terms and conditions are set out to explain our responsibilities to you and your responsibilities to us as the Consignor/Consignee. They also include important provisions that restrict and/or limit our liability.

 

1.Booking Deposit

A 50% deposit is due upon booking transportation; The remaining balance is due 7 days before job completion unless otherwise agreed. Deposits and full payments can be paid by bank transfer or credit/debit card.

 

Pre-Approved Account Payment Terms

a, Payments to be made via BACS within 30 days of the invoice date, unless otherwise stated on the invoice supplied.

b, Failure to make payment in full within the time frame stated on the invoice will incur an 8% late payment fee per month.

3, Loading/Unloading

a, All loading and unloading of vehicles onto our vehicles will be completed by our driver. There will be no exceptions.

b, If additional equipment is required to load the trailer i.e. a forklift/crane this is the responsibility of the consignor/consignee to organise and pay for this prior to our arrival.

c, In the event of additional equipment being required i.e. forklifts/cranes, the operator will be required to follow the instructions of the Highways Transport driver regarding loading.

d, In the event of the vehicle not being as stated i.e. starts/drives/rolls and therefore requires specialist equipment in order to load, an additional cost will be incurred.

e, If the driver is kept waiting to load/unload then a waiting time charge of £45 per hour will be charged to the consignee.

f, If we arrive and we are unable to collect the vehicle/item through no fault of our own (i.e. the consignor refuses to release the vehicle/item) or the item is not as described (i.e. the item is over our payload weight) we hold the right to retain funds already paid.

 

4, Consignor/Consignee Load Responsibility

a, It is the responsibility of the consignor/consignee to ensure that all items on the vehicle are secure for transport. We will not be held responsible for any items that fall off or any damaged caused to the vehicle from said insecure items during transportation.

b, It is the consignor/consignee’s responsibility to know the condition of the vehicle/item. Highways Transport accepts no responsibility in regards to the condition of the vehicle/item if it has been purchased unseen by the consignee.

c, Any discrepancies with the vehicle/items condition must be taken up with the consignor.

d, Highways Transport can give basic vehicle inspections i.e. check bodywork and report this to the consignee. However, this is subjective and Highways Transport will not accept responsibility if this falls below the consignee’s expectations.

e, Any keys/documentation in relation to the vehicle/item must either be left within the vehicle or handed to the driver.

f, If we arrive to collect a vehicle/item and there are additional items that haven’t been disclosed to Highways Transport, we reserve the right to refuse to load these items or charge an additional charge to the consignor/consignee.

g, If we arrive to collect a vehicle/item and it is heavier than Highways Transport have been informed, we reserve the right to refuse to load or charge an additional charge to the consignor/consignee.

h, It is the consignor/consignee’s responsibility to ensure that the vehicle/item is ready to be loaded on our arrival i.e. cleared funds.

 

5, Passengers

Passengers will not be authorised to travel in our vehicles. You are responsible for making your own travel arrangements, unless deemed necessary by the driver in the event of an emergency.

 

 6, Unacceptable Behaviour

Unacceptable, threatening, offensive or illegal behaviour will not be tolerated under any circumstances. The driver holds the right to refuse the transportation of the load and no refund or compensation will be given in these circumstances.

 

Prohibited uses

You may use our services only for lawful purposes. You may not use our services:

a, In any way that breaches any applicable law or regulation.

b, In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

 

Website/Social Media Content

a, We aim to update our website regularly, and may change the content at any time. If the need arises, we may suspend access to our website, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

b, All content including photos and text on our website and social media pages are covered by copyright laws and are owned by Highways Transport.

 

Cancellations

For all jobs booked the following time schedules apply in regards to refunds.

a, 30+ days- a full refund given, less a 10% admin charge.

b, 14+ days – 50% refund given, less a 10% admin charge.

c, less than 14 days – no refund given.

d, all refunds will incur a 10% charge to cover our administration costs.

e, We are not responsible for any cancellations due to any pandemic illnesses.

 

Rescheduling

a, If you need to amend the date of your transportation we politely ask for a minimum of 14 days so that we can reschedule our routes for that week. Please refer to section 2 of our cancellation policy.

b, If you wish to reschedule and you are within the 14 days notice period, your deposit can be transferred to the new booking date.

c, If rescheduling and your booking falls under the 14 days you will be required to pay a new deposit to secure your booking.

d, In the event of a mechanical breakdown with one of our vehicles we will reschedule at no extra cost.

e, In the event of adverse weather conditions that prevent the collection/delivery of the vehicle/item we will reschedule at no extra cost.

 

Subcontractors

Highways Transport occasionally work alongside and use the services of subcontractors. These contractors have all the necessary insurances to ensure your vehicle/item is covered, and will transport your vehicle on our behalf. Our terms and conditions still apply when a subcontractor is involved in the transportation.

 

Cash Handling

On occasions, we are asked to carry cash with us to hand over to the Consignor for a vehicle/item that we are collecting. The process we use for this is as follows:

a, The Consignee will be asked to place the cash into a security cash bag called a ‘Versapak’.

b, The bag is then sealed using a security seal which has a unique number printed onto it.

c, The security seal number is then recorded by ourselves and the Consignee. The Consignee will then pass the security number onto the Consignor. Upon delivery, the Consignor will then check the security seal is intact and verify the unique number to show the security cash bag has not been tampered with during transit.

 

Should there be any discrepancies with the contents of the security bag; the Consignee and Consignor are to resolve the matter between themselves. Highways Transport does not hold any responsibility for the contents of the security cash bag.
